Terms and Conditions

1. Definition

In the general terms and conditions the following terms have the following meaning:
a. A Cup of Cake, hereinafter referred to as: 'A Cup of Cake'.
b. Client: A client is a legal entity that uses the services of A Cup of Cake.

2. Orders

2.1. Order times
The client can place orders 24 hours a day, 7 days a week on www.acupofcake.nl. Also by telephone or directly in the boutique during store opening hours.

2.2. Large orders
For larger orders: 500 cupcakes or more, the client must contact A Cup of Cake. A Cup of Cake will then contact the client as soon as possible to discuss the order and agree on a suitable delivery/collection date.

2.3. Logo/image on cupcake
A logo/image is printed on a wafer/chocolate surface using edible ink. The logo/image must be sent by the client in JPEG, EPS, PDF, PNG to info@acupofcake.nl. Deviations in color may be possible as edible ink is used. Please send the logo immediately after ordering to avoid delays.
2.4. Minimum purchase
There is no minimum purchase.
2.5. Allergy / Intolerance
A Cup of Cake products may contain the following substances: chicken egg, gluten, cow's milk, lactose, nuts, peanuts, soy, wheat, fructose, histamine, chocolate, vanilla, fruit, caffeine, various vegetable oils, flour, sugars , dyes, different E numbers. For more information about the ingredients in your chosen product, please contact us by telephone or email.

3. Delivery

3.1. Delivery times
For cupcakes that need to be delivered, a delivery time of at least 24 hours applies from the time of order.
For “large and unusual orders”, the delivery time will be determined together with the client. Faster delivery times may be available for collection from the boutique.

Deliveries generally take place from Tuesday to Friday. between 8:30 am and 5:30 pm. In general, delivery does not take place on Sundays, public holidays, Queen's Day and New Year's Day, only after consultation. A Cup of Cake reserves the right to deviate from the above delivery times. If the client has specified a desired delivery time, this is an indicative time and no rights can be derived from it. A Cup of Cake is not responsible for redelivery of the package in the event of incorrect or incomplete addressing. A Cup of Cake is not responsible for redelivery or refund if the product is refused at the delivery address.
Make sure there is someone present who can accept the cupcakes, as they are a fresh product.

3.2. Episode
For companies, the cupcakes are delivered to the reception if present. A Cup of Cake is not responsible for internal delivery. If the cupcakes cannot be delivered to the delivery address, the driver will attempt to deliver the cupcakes to a nearby address. If this is not possible, the cupcakes will be taken back and a new appointment will be scheduled. The cupcakes are then stored for 24 hours. Subsequent delivery will only take place in consultation with the client; the client must contact A Cup of Cake himself. Subsequent delivery will entail additional/new delivery costs.

3.3. Urgent delivery
If the client wants to order cupcakes urgently, the client must contact A Cup of Cake by telephone.

3.4. Signature
The order must be signed for. These signatures are kept for 3 months after the delivery date and are then destroyed.

3.5. Force majeur
A Cup of Cake is not liable for force majeure. Force majeure means: abnormal and unforeseen circumstances that are independent of the will of the person invoking them and the consequences of which could not be avoided despite all precautions, such as natural disasters, strikes, prolonged internet disruptions, etc.

3.6. Delay/damage
A Cup of Cake cannot be held liable for delays in delivery or any damage caused by third parties such as an external courier service. Shipping is entirely at the client's own risk. Of course, we will always look for a correct solution if the products are damaged or delivered late.

3.7. To take off
Collection of the order is possible in the boutique in Breda. Address: Veemarktstraat 69, 4811ZD Breda.

4. Prices

4.1. All prices stated on the website www.acupofcake.nl include 9% VAT and in euros.

4.2. Prices are subject to typographical errors and changes.

4.3. Prices will not be increased within the duration of the offer, unless legal measures make this necessary.

4.4. All prices on the site are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.

5. Payment

5.1. Billing
For business clients, the invoice will be sent by A Cup of Cake within 1 week after delivery of the order. Unless otherwise agreed in writing, payments must be made net within 14 days. For a total amount higher than 500 euros, we require a minimum down payment of 35% of the total amount. This amount must be paid before the delivery date.

5.2. Private individuals
For private clients, invoicing is not immediately possible and the following payment method can be used: iDeal, credit card or payment in the boutique; cash or by card.

5.3. Discount
Discounts offered only apply if the invoice is paid within the specified period of 14 days. When using discount codes for payment, A Cup of Cake determines whether the discount has been applied correctly and we therefore decide whether the discount can be granted. In the event of incorrect application, A Cup of Cake reserves the right to cancel the order.

6. Liability

6.1. Addressing/data
A Cup of Cake cannot be held liable for providing incorrect addresses and/or delivery dates.

6.2. Logo/text
A Cup of Cake cannot be held liable for printing and/or typesetting errors of logo/image and text.

6.3. Deliver
A Cup of Cake cannot be held liable for delays in delivery or any damage caused by third parties such as an external courier service. Shipping is entirely at the client's own risk. Of course, we will always look for a correct solution if the products are delivered damaged.

7. Cancellation

7.1. By client
To cancel an order, the client must contact A Cup of Cake. This can be done by telephone or email. A Cup of Cake cannot guarantee that the order can be canceled free of charge. Any costs will be charged to the client in the event of cancellation.

7.2. By A Cup of Cake
A Cup of Cake reserves the right to refuse orders that must be provided with insulting or objectionable images and/or texts without giving reasons to the client.
8. Returns

8.1. All items, with the exception of fresh products (products that can spoil), can be returned within 7 days of receipt, after which the total purchase amount excluding delivery costs will be transferred to a bank account number to be specified in advance. However, it is expressly stated that the seal/packaging of the items must not be broken and the items must be delivered to A Cup of Cake in an undamaged condition. This is in accordance with the Distance Selling Act. If this aspect is not taken into account, we unfortunately cannot take back the items and cannot cancel the payment.

8.2. You are obliged to check whether the items delivered to your home comply with the order. If this is not the case, you can report this to us by email within 24 hours, stating the order number and a clear explanation of why the item does not comply. A Cup of Cake will replace the item or reverse payment if it is shown that you do not accept the item for valid reasons. In the exceptional case that an item is delivered that does not meet the order, A Cup of Cake reserves the right to replace the item with a new one or to return the amount paid excluding delivery costs.

9. Changes

To report a change, the client must contact A Cup of Cake. This can be done by telephone or email. A Cup of Cake cannot guarantee that the order can be changed. Any costs associated with changes will be charged to the client.

10. Complaints about orders

You can contact A Cup of Cake for complaints and questions on working days from 10 a.m. to 5:30 p.m. This can only be done via email. Complaints will be processed up to 5 days after confirmation or delivery.

11. Appearance

11.1. Product
The appearance of our products may differ from the products shown on www.acupofcake.nl. The cupcakes are delivered in special cardboard cupcake boxes, approved by the Food and Drug Administration.

11.2. Packaging
In most cases, our packaging is provided with an A Cup of Cake logo. Packages shown may vary. If the products you order must be packed in packaging without this logo, you must indicate this by email before placing your order.

12. weights
Any stated weights of our products are indicative and may deviate by a margin of 10%.
13. Word and figurative marks protected
All word and image marks on this website are the property of A Cup of Cake unless otherwise stated. It is not permitted to use these brands without the prior written permission of A Cup of Cake. Any unauthorized use is considered trademark infringement and will be combated with all possible legal means.

14. General terms and conditions for packages and (group) reservations

Article 1 – What is a group reservation
1.1. A reservation for 6 people or more

Article 2 - Conclusion of the agreement
2.1. An agreement is concluded when A Cup of Cake and the customer have reviewed the confirmation by telephone or in writing and have entered into an oral or written agreement. The confirmation will then be sent by A Cup of Cake. An agreement by email is assumed to be a final confirmation.
2.2. The person who enters into the agreement on behalf of or for the benefit of the group (the customer) is jointly and severally liable for all obligations arising from this agreement.

Article 3 - Payment
3.1. The package costs or the agreed down payment must be received by A Cup of Cake no later than 7 days before the start of the reservation, unless otherwise agreed in writing. If payment is not made on time, A Cup of Cake is entitled to cancel the booking. Money already paid will not be refunded; the cancellation provisions stated in article 6 of these conditions will then continue to apply.

Article 4 - Arrangement costs
4.1. The published amount includes: All snacks and drinks as described in the information kit or email.
4.2. The package costs do not include:
a. any additional costs for additional drinks, if only tea and a welcome drink have been agreed for a high tea.
b. Garland and balloon decorations in the room that can be ordered (extra).
4.3 Point a. is paid by the customer on the day itself in the boutique by card or cash.
4.4. Unless stated otherwise, published prices are per person.
4.5. The published prices are based on the prices and conditions as they were known when the program was drawn up. A Cup of Cake reserves the right to change the price before the booking is made if there is reason to do so due to price increases from third parties, including the applicable VAT regulations.

Article 5 - Changes by the customer
5.1 Changes to products (such as snacks/drinks, etc.) by the customer in the agreed arrangement can be arranged if and insofar as this is possible and up to 48 hours in advance.

Article 6 - Cancellations
6.1. If a confirmed reservation is canceled or changed in terms of numbers, the following amounts will be charged per reservation, unless otherwise agreed.
a. in case of complete cancellation more than fourteen days before the intended time, 10% will be charged.
b. In case of complete cancellation more than five days before the commencement date, the customer is required to pay 25% of the amount due.
c. In case of cancellation five days or less before the commencement date, the customer is obliged to pay 75% of the amount due.
6.2. Cancellations must be communicated by email: info@acupofcake.nl. This cannot be done by telephone.
6.3. Reduction of the number of participants within a margin of 20% can be made up to 48 hours before the start. After that, the last known group size applies.
6.4. For reductions in the number of participants greater than 20%, the cancellation provisions will apply. Reporting a reduction or increase in the number of participants must be communicated by e-mail to info@acupofcake.nl. This cannot be adjusted by telephone.

Article 7 - Cancellation of the arrangement/changes
7.1. If, due to circumstances solely within A Cup of Cake's own business operations, A Cup of Cake decides that the reservation cannot proceed or that changes are made, A Cup of Cake undertakes to immediately notify the customer.
7.2. If the event does not proceed, A Cup of Cake undertakes to immediately refund the arrangement costs already paid (in whole or in part).

Article 8 - Complaints arrangements
8.1. Despite all the love and care, it is possible that the customer believes he has a justified complaint. This complaint must be submitted immediately to the operating staff, so that adjustments/changes can be made on the day itself. If direct submission of a complaint is not possible, or if the complaint is not satisfactorily resolved, we request that you send the complaint by email to A Cup of Cake within 2 weeks at the latest.

Article 9 - General reservation
9.1. A Cup of Cake reserves the right to make changes to the program and packages if there are valid reasons for doing so.
9.2. A Cup of Cake accepts no responsibility for photos, brochures and other information material, insofar as published by third parties.

Article 10 - agreed times for arrangements
10.1. The agreed start and end time must be adhered to by the customer. A Cup of Cake has 1 'private room' available (The Rainbow Room) for larger groups. This space may be rented out several times a day for different group reservations. It is therefore not always possible to extend the arrangement time on the day itself. If you want to book for longer than 2 hours, please indicate this when making your reservation.
10.2. The group arrangements are scheduled for a maximum of 2 hours, unless otherwise agreed. If unlimited tea or lemonade has been agreed and the two hours are exceeded, any additional costs for tea or other agreed drinks can be charged. The service staff will always inform you of this.

Article 11 - Liability
11.1. If and to the extent that timely payment is not made, the customer is in default without any notice of default being required.
11.2. If the customer is in default, he must reimburse all costs related to collection, both judicial and extrajudicial.
