General Terms and Conditions The Cake Room

1. Definitions

In these General Terms and Conditions, the following terms have the following meanings:

  • The Cake Room : The company The Cake Room, located at Veemarktstraat 69, 4811ZD Breda.
  • Client : The natural or legal person who places an order or uses the services of The Cake Room.
  • Consumer : The private client who is not acting in the exercise of a profession or business.

2. Orders

2.1 Order times

Orders can be placed 24/7 via www.thecakeroom.nl and during opening hours by telephone or in the boutique.

2.2 Large orders

For orders of 500 cupcakes or more, the Client must contact The Cake Room. The Cake Room will determine the order and delivery date in consultation.

2.3 Logo/Image on products

Logos or images are applied with edible ink on a wafer or chocolate background. Color deviations may occur. Files must be supplied in JPEG, EPS, PDF or PNG format via info@thecakeroom.nl .

2.4 Minimum order quantity

There is no minimum purchase requirement.

2.5 Allergies and intolerances

Our products may contain allergens. The Cake Room is not liable for allergic reactions. Please contact us for specific ingredient information.

3. Delivery and Collection

3.1 Delivery times

Delivery usually takes place from Tuesday to Friday between 08:30 and 17:30. On Sundays and public holidays, delivery is only possible after consultation. Delivery times stated are indicative.

3.2 Delivery and liability

  • Orders will be delivered to the address provided. In case of incorrect or incomplete address details, The Cake Room is not responsible for redelivery or refund.
  • Business orders will be delivered to the reception, if available.
  • If delivery is not possible, an attempt will be made to deliver the order to a nearby address. If this is not possible, a new appointment will be made at the expense of the Client.

3.3 Force Majeure

The Cake Room is not liable for delays or non-delivery due to force majeure, such as natural disasters, strikes or transport disruptions.

4. Prices and Payment

4.1 Pricing

All prices include 9% VAT and are expressed in euros. The Cake Room reserves the right to change prices.

4.2 Payment terms

  • Invoices must be paid within 14 days unless otherwise agreed.
  • For orders above €500 a 35% deposit is required.
  • Consumers can pay via iDeal, credit card, or cash/pin in the boutique.

5. Cancellation and Reservations

5.1 Cancellation by Client

Cancellation must be communicated by email or telephone. Possible costs may be charged.

5.2 Cancellation by The Cake Room

The Cake Room reserves the right to refuse orders with offensive or objectionable content.

5.3 Reservations with deposit or full payment

For reservations such as theme parties (e.g. Princess Party) or group reservations that require a deposit or full payment, cancellations within 7 days prior to the reserved date are not refundable. This policy applies regardless of the reason for cancellation.

6. Returns and Complaints

6.1 Fresh products

Returns are not possible for perishable products.

6.2 Inspection upon receipt

The Client must check orders upon receipt and report any deviations within 24 hours.

6.3 Complaints

Complaints can be reported within 3 days after delivery via info@thecakeroom.nl . The Cake Room strives for a suitable solution.

7. Liability

  • The Cake Room is not liable for damage caused by incorrectly provided information by the Client.
  • Shipment is at the risk of the Client.
  • The Cake Room is not liable for damage caused by third parties, such as external courier services.

8. Appearance and Brand Protection

  • Products may differ from the images shown on the website.
  • All word and image marks of The Cake Room are protected. Unlawful use will be legally dealt with.
